Ruling on Discovery

On August 17, 2010, Judge Black ruled on the discovery dispute rejecting the Defendants' request to conduct discovery on all recovery agents. The Judge agreed with Plaintiffs that discovery of a representative sample of agents was sufficient. The Court ruled that Defendants could serve written discovery on the 9 original Plaintiffs and 22 additional Plaintiffs who later joined the case and could take depositions of 16 Plaintiffs of their choice. He directed the parties to agree to a schedule of deadlines for discovery and the filing of decertification and summary judgment motions and present it to the Court in 10 days.  This case is once again moving forward.
