Monahan v Smyth Automotive

Monahan, et al. v. Smyth Automotive. Smyth Automotive automatically deducts 30 minutes per day from wages of its delivery drivers for a lunch break. However, most delivery drivers are not able to take a lunch break regularly because of the demands of the job. We are seeking to recover the deductions from pay. The case is before Judge Arthur S. Spiegel.

On June 21, 2011, Judge Arthur S. Spiegel approved a confidential settlement between the Plaintiffs and Employer finding that the settlement was fair and reasonable. The case was dismissed with prejudice, with the Court retaining jurisdiction over the settlement for purposes of its enforcement.
